ABC123 Inflatables Rental Agreement
1. Severability
If any provision of this agreement is found to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall remain in full force and effect.
2. Responsibility of Use & Disclaimer of Warranties
The renter assumes full responsibility for the operation, possession, and use of the rented equipment. The renter acknowledges and accepts all risks associated with the use of the equipment and agrees to indemnify, defend, and hold harmless ABC123 Inflatables, its employees, and affiliates from any claims, liabilities, damages, injuries (including death), or losses that may arise from the use of rented equipment.
This release of liability applies regardless of whether the damage or injury results in whole or in part from the negligence of ABC123 Inflatables, equipment defects, or any other cause.
No Warranties
All rented equipment is provided “as is.” ABC123 Inflatables makes no warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose. The renter agrees that no guarantees or warranties have been made regarding the performance or safety of the equipment.
3. Equipment Failure
If any rented equipment becomes unsafe or in disrepair, the renter must immediately discontinue use and notify ABC123 Inflatables within one (1) hour. At its sole discretion, ABC123 Inflatables may:
- Repair the equipment within a reasonable time,
- Replace it with a similar item if available,
- Provide a rental credit for future use,
- Adjust rental charges accordingly.
This provision does not relieve the renter of their contractual obligations. ABC123 Inflatables is not liable for injuries or damages resulting from equipment failure.
4. Use of Equipment
The renter acknowledges they are familiar with the proper and safe operation of the rented equipment. By accepting the rental, the renter confirms they have received adequate instruction or are otherwise competent to use the equipment safely.
Equipment must:
- Be used only at the address listed on the rental contract and for its intended purpose.
- Not be subleased, assigned, or used improperly.
- Be operated in compliance with all applicable laws, safety guidelines, and manufacturer instructions.
5. Time of Return & Late Returns
The renter’s right to possess the equipment expires at the end of the rental period as stated in the contract. Time is of the essence.
- The renter must return all equipment during regular business hours on or before the due date.
- Late returns will result in additional rental fees until the equipment is returned.
6. Payment Terms
- All rental charges are due in full before delivery or pick-up.
- Payment methods accepted: Visa, Discover, MasterCard, American Express, Apple Pay, and Google Pay. Personal checks are not accepted.
- If payment is not received by Wednesday of the event week, ABC123 Inflatables reserves the right to charge the remaining balance to the credit card on file.
- A 2.0% service charge per month will apply to past-due accounts.
7. Security Deposit & Cancellation Policy
A 50% non-refundable security deposit is required at the time of booking.
Cancellations
- Orders (excluding tents) must be canceled at least 14 days before the event for a full refund of the deposit.
- Tent reservations must be canceled at least 6 weeks in advance for a full refund.
- Cancellations made within 14 days (or 6 weeks for tents) will result in forfeiture of the 50% deposit.
Rescheduling: If a renter cancels within the forfeiture period, they may apply the deposit toward a future rental within 12 months, subject to availability. If originally rented items are unavailable, similar replacement items may be provided.
8. Delivery & Pick-up
- Delivery and pick-up services are available at an additional charge.
- Equipment is delivered to the nearest accessible point on the ground level. Additional charges may apply for deliveries requiring stairs, elevators, or long-distance transport.
- Set-up and breakdown services are available for an additional fee.
Delivery Timing
- Deliveries for weekend events may occur as early as Tuesday or Wednesday, depending on workload and weather conditions.
- Pick-ups scheduled for Monday may be delayed due to inclement weather or workload.
The renter is responsible for equipment from the time of delivery until the time of pick-up.
9. Site Preparation & Permits
- The renter must obtain all necessary permits and licenses before installation.
- If installation requires underground stakes, the renter must confirm no underground utilities are present before delivery.
- ABC123 Inflatables is not responsible for damage to underground utilities, sprinkler systems, or landscaping.
10. Hold Harmless Agreement
The renter agrees to hold ABC123 Inflatables harmless against any claims, losses, or damages, including but not limited to:
- Injury or property damage from use of rented equipment.
- Contact with underground utilities.
- Damage to landscaping, sidewalks, or driveways.
- Necessary repairs to the site after equipment use.
11. Equipment Responsibility & Cleaning Fees
- The renter is responsible for equipment from the time of receipt until the time of return.
- Equipment must be returned clean and in the same condition as received.
- Cleaning charges will apply if items are returned dirty.
The renter will be charged for missing, damaged, or broken items based on full replacement cost.
12. Photo Release Agreement
By signing this rental contract, the renter grants ABC123 Inflatables permission to use event photographs for marketing, promotions, and social media.
Opt-Out Option: If the renter does not consent to photo usage, they must notify ABC123 Inflatables in writing before the event date.
